Introduction

This memorandum is submitted to inform the court of a violation of Act 5.2 of the public and moral conduct laws by Marjo. The defendant engaged in unwanted sexual touching against [R*]Kawashty on 30/03/2024 at Bohan Gas Station.

Facts of the Case

While eating at Bohan Gas Station Market on 30/03/2024, the defendant, Marjo, touched [R*]Kawashty in a sexual manner without their consent. This unwanted touching caused [R*]Kawashty to feel discomfort.

The specific actions of the defendant included forcefully kissing the back of [R*]Kawashty's neck.
There was use of force and kissing was accompanied by grabbing and pinning.
[R*]Kawashty reacted to the touching by showing discomfort, verbally expressing discomfort by saying "Stop that!" and pulling away from showing facial expressions of distress.

Legal Analysis

Act 5.2 of the public and moral conduct laws clearly states that touching another person in a sexual manner without their consent is a crime. The actions of the defendant, as described above, constitute a violation of this Act.

Relief Requested

We request the court to find the defendant guilty of violating Act 5.2 and impose the appropriate punishment as outlined in the law (up to 10 minutes of imprisonment). Additionally, [R*]Kawashty may seek Moral Compensation Around 10K Ard.

Conclusion

The unwanted sexual touching by the defendant is a clear violation of Act 5.2.  We urge the court to hold the defendant accountable for their actions and provide justice for [R*]Kawashty.

Introduction

I, Marjo, through my counsel Lucius Barrington, submit this formal response to the allegations made under Act 5.2 of the Criminal Laws of Liberty City of IV:MP, detailed in the memorandum from Ray Fearon on behalf of [R*]Kawashty. This defense respects both in-character (IC) integrity and the out-of-character (OOC) rules of our server's roleplay environment.

Defense Points

- Absence of Defendant: In accordance with Act 2.1, the Presumption of Innocence, I assert that I was not present at the alleged incident's location and no in-game evidence has been provided to prove my character's involvement or presence at Bohan Gas Station on the specified date.

- Unauthenticated Allegations: As defined in Act 1.2, the claim lacks the legal structure to proceed without any in-character authorization or identification of my character in the purported act.

- (( Invalidity of OOC Evidence for IC Proceedings )): The evidence put forward is an OOC screenshot, which does not hold in-game evidentiary value as per the server's regulations. Roleplay justice is founded upon IC actions and proofs, and any material not gathered within the IC context cannot form the basis of a legitimate claim.

- (( Roleplay Standards Compliance )): The plaintiff's reliance on a screenshot contradicts our server's roleplay rules regarding mixing IC and OOC. There was no in-character action taken to record or document the incident, thus the claims lack the substantiation required by the roleplay standards of the server.

Conclusion

Given the absence of valid in-character evidence and the reliance on inadmissible OOC materials, this defense strongly requests the dismissal of the allegations. The integrity of roleplay and the distinction between IC and OOC elements are of the utmost importance in our community and must be preserved.
